What if I am not satisfied with the AIRC's decision?If you are dissatisfied with the decision, you have a right to appeal to the Full Bench of the AIRC. The only ground of appeal that you can argue is that the Commission was in error in deciding to make the order. Appeals must be lodged within 21 days of the decision you are appealing. You should get legal advice if you are considering appealing. Costs in the Australian Industrial Relations CommissionGenerally, both you and your employer have to pay your own legal costs, regardless of the outcome. However, the AIRC does have the power to order you to pay the employer's legal costs if your application was vexatious or made without reasonable cause, or where you acted unreasonably by failing to discontinue your application when the AIRC had indicated that it had no merit.
